Welcome to Hey Feelings (“the App”), a mobile application owned and operated by Tales Labs sp. z o.o. (“Tales Labs,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the App, as well as any related websites, products, services, and content provided by us.

By downloading, installing, or using the App, you (“you,” “your,” or “User”) agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the App.

3. Eligibility

1. Age Requirement: You must be at least the age of majority in your jurisdiction to use this App. If you are a minor, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2. Legal Capacity: By using the App, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

4. License

Subject to your compliance with these Terms, Tales Labs grants you a personal, non-transferable, non-exclusive, revocable, limited license to download, install, and use the App on your mobile device, strictly in accordance with these Terms and any applicable usage rules or terms set forth by the Apple App Store or Google Play Store.

5. User Account

• Using any automated means or processes to access or collect information from the App without our explicit permission.

3. Consequences: We reserve the right to suspend or terminate your account if you violate these Terms or engage in any conduct we consider inappropriate or disruptive.

7. Intellectual Property

1. Ownership: All text, graphics, user interfaces, visual interfaces, trademarks, logos, sounds, artwork, and computer code related to the App (collectively, “Content”) are the property of Tales Labs or its licensors.

2. Limited License to Content: You may use the Content solely for your personal, non-commercial purposes as intended through the normal functionality of the App.

3. Restrictions: You agree not to copy, modify, distribute, create derivative works from, publicly display, publicly perform, republish, or transmit any Content without our prior written consent.

10. Disclaimer of Warranties‍

1. App Provided “As Is”: The App is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Tales Labs disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

2. No Guarantee of Error-Free Operation: We do not guarantee that the App will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

3. No Medical or Psychological Advice: The App may provide insights or suggestions regarding emotional well-being or related topics; however, it does not offer professional medical or psychological advice. If you need professional help, please consult a licensed healthcare provider.

11. Limitation of Liability

1. Exclusion of Liability: To the extent permitted by law, Tales Labs and its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of, or inability to use, the App.

2. Maximum Liability: If, notwithstanding the other provisions of these Terms, Tales Labs is found to be liable to you for any damage or loss arising out of or in any way connected with the App, Tales Labs’ liability shall in no event exceed the total fees, if any, paid by you to us in the six (6) months preceding the event giving rise to the liability.

12. Indemnification‍

You agree to indemnify, defend, and hold harmless Tales Labs, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

1. Your access to or use of the App.

2. Your violation of these Terms.

3. Your violation of any third-party rights, including without limitation any intellectual property or privacy right.

13. Modifications and Termination

1. Modifications to Terms: We reserve the right to modify these Terms at any time. Changes will become effective immediately upon posting to the App or our official website. Your continued use of the App after the posting of any updated Terms constitutes your acceptance of the changes.

2. Termination of Use: We may suspend or terminate your account or your access to the App at any time, for any reason, including if we believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable under applicable law, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tales Labs regarding your use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Tales Labs.
